Important information regarding our association!

On February 6th, an extra association meeting was held at Bio Cosmopolite in Brandbergen. The extra meeting intended to vote on the board’s proposal to grant land with easement for waste management.

The meeting approved the board’s proposal, which meant that Victoriahem would be allowed to build waste stations on the association’s land without paying.

It concerns approximately 10 square meters near our existing waste bins on Fiskarnas Gata and Vattumannens Gata. Victoriahem will install their own waste bins on our land, similar to ours, and they will pay for the installation and waste management. To do this, they need permission to use our land.

The board’s proposal is that they receive permission for this purpose only and only for these small pieces of land. This permission is officially registered and means that the association cannot take back the land without Victoriahem’s approval, even if they sell their properties.

The meeting voted yes to the board’s proposal to allow Victoriahem to take the land!

The board had said that the decision must be approved twice, but now they have provided new information that their lawyers say that such decisions only need to be voted on once.

What does this mean?

This means that our association will give away land to Victoriahem so that they can build their waste stations on the association’s land completely free of charge.

It is well-known that tenants generally do not have the same sense of responsibility as homeowners.

What can we do?

Step 1 Apply to the board for an extra association meeting regarding this matter ✊

According to the Law on Economic Associations, Chapter 6, Section 12, the board is obliged to convene an extra association meeting if at least one-tenth of all voting members, or the lesser number specified in the bylaws, request in writing that such a meeting be convened to address a specified issue.

According to the Bylaws of BRF Väduren, under the section General Meeting, Section 13, it states: ”An extra association meeting shall also be held if requested in writing by an auditor or at least one-tenth of all voting members.”  

This means that in order to make a change in this matter, we must convene an extra meeting to vote on it.

We need to have at least 10% of voting members for the application to go through.

Step 2 We must attend the extra association meeting and vote NO!

Who is eligible to vote?

According to the Bylaws of BRF Väduren, under the section Extra General Meeting, Section 18, it states: ”At the general meeting, each member has one vote. If several members share a condominium, they have one vote together. If a member owns several condominiums in the condominium association, the member has one vote. Members who have not paid their fees or annual dues are not eligible to vote.”

In simple terms, this means that:

  • Each member at the meeting gets to vote.
  • If multiple members share a condominium, they have one vote together.
  • If a member owns multiple condominiums, they only have one vote. Members who have not paid their fees cannot vote.

This is a fantastic opportunity for our association to increase its income, which can then be used to improve our common area or finance future projects, such as pipe replacements, and thus avoid increasing fees for us residents.

Did you know that there are actually associations that pay money to their residents monthly instead of charging a fee every month?

Even if our association may not be at the same level as others, every decision we make is important. If we now have the opportunity to charge for allowing Victoriahem to use our land, why not take advantage of that opportunity?

If we are going to have to deal with their trash, then we should get paid for it!
